PURPOSE:
City Council approval is requested for a change order to Contract 2013-0900 (EL-5101DL Parts C & D) for the Pisgah Church Road, Lees Chapel Road, and Yanceyville Street Sidewalk Improvements Project. This change order for $400,000.00 is to account for additional work required to complete this project.
BACKGROUND:
This project includes Federal funding and is subject to the U.S. Department of Transportation Disadvantaged Business Enterprise (DBE) program. The M/WBE Program Plan expressly states, "...the following categories of contracts shall be excluded from the scope and application of this Program Plan: (a) Contracts that are subject to the U.S. Department of Transportation Disadvantaged Business Enterprise Program and Airport Concessions Disadvantaged Business Enterprise Program as set forth in 49 CFR Parts 23 and 26 or any successor regulations or legislation."
Contract 2013-0900 (EL-5101DL Parts C & D) in the amount of $6,287,104.75 was issued to Atlantic Contracting Company, Inc. on October 15, 2019, for the Pisgah Church Road, Lees Chapel Road, and Yanceyville Street Sidewalk Improvements Project. During construction, additional work needed within the right of way was discovered that resulted in additional construction costs. This additional work included additional retaining walls, corresponding handrail, and excavation needed to install the retaining walls.
