PURPOSE:
City Council approval is requested for a change order to Contract 2013-0900 (EL-5101DL Parts C & D) for the Pisgah Church Road, Lees Chapel Road, and Yanceyville Street Sidewalk Improvements Project. This change order for $400,000.00 is to account for additional work required to complete this project.
BACKGROUND:
This project includes Federal funding and is subject to the U.S. Department of Transportation Disadvantaged Business Enterprise (DBE) program. The M/WBE Program Plan expressly states, “...the following categories of contracts shall be excluded from the scope and application of this Program Plan: (a) Contracts that are subject to the U.S. Department of Transportation Disadvantaged Business Enterprise Program and Airport Concessions Disadvantaged Business Enterprise Program as set forth in 49 CFR Parts 23 and 26 or any successor regulations or legislation.”
Contract 2013-0900 (EL-5101DL Parts C & D) in the amount of $6,287,104.75 was issued to Atlantic Contracting Company, Inc. on October 15, 2019, for the Pisgah Church Road, Lees Chapel Road, and Yanceyville Street Sidewalk Improvements Project. During construction, additional work needed within the right of way was discovered that resulted in additional construction costs. This additional work included additional retaining walls, corresponding handrail, and excavation needed to install the retaining walls.
The DBE goal for this project is 10.0%. Atlantic Contracting Company, Inc. is a DBE firm and will continue to achieve a DBE commitment of 10.0% with its own workforce.
BUDGET IMPACT:
Funds for this change order will come from the Transportation Bond Fund account 471-4502-15.6015 A11132 in the amount of $400,000.00.
RECOMMENDATION / ACTION REQUESTED:
The Engineering & Inspections and Transportations Departments recommend that City Council approve this change order for $400,000.00 for Contract 2013-0900 (EL-5101DL Parts C & D) to Atlantic Contracting Company, Inc.
