PURPOSE:
The purpose of this ordinance is to amend Section 10.5-10 of Chapter 10.5, Hazardous Waste Management, of the City Code to require Board of Adjustment review and approval for special use permits related to hazardous waste management activities.
BACKGROUND:
As directed by City Council, staff evaluated the application processes handled by the Planning Board, Zoning Commission and Board of Adjustment to better align the board’s/commission’s purpose and expertise with the items being decided.
During that evaluation, it was discovered that special use permits for hazardous waste management activities (which require a quasi-judicial hearing) needed to be shifted from the Planning Board (a legislative body) to the Board of Adjustment, which is a quasi-judicial board.
BUDGET IMPACT:
This item will have no budget impact.
RECOMMENDATION / ACTION REQUESTED:
Staff recommends that City Council consider adoption of the proposed amendment.
