PURPOSE:
The Property Management Section of Engineering and Inspections Department is in the process of providing Duke Energy with an access easement across city property at Latham Park, in exchange for a drainage easement. The easement requested by Duke Energy will provide them with access for a utility installation project adjacent to an existing tower. The drainage easement provided to the City is advantageous for further development and construction on site at the park. Duke Energy would also like to convey a portion of their property to the City currently impacted by the Latham Park greenway, as a fee simple transaction. City Council approval is requested for the easements and acceptance of property conveyance.

BACKGROUND:
Latham Park is located at 601 Open West Wendover Avenue and runs linear along North Buffalo Creek from Hill Street to North Elm Street. The Hill street side of Latham Park will be home to the new skate park development adjacent to the Latham Park Greenway. Duke Energy is seeking to install a Verizon Wireless static utility installation adjacent to an existing tower and the greenway. In order to facilitate the process of approval for both projects, the City and Duke Energy have collaborated to provide each other with access easements at the site. The proposed access easement from the City to Duke Energy is approximately 2,653SF. The proposed drainage easement from Duke Energy to the City is approximately 1,511SF.
