PURPOSE:

The Property Management Section of Engineering and Inspections Department is in the process of providing Duke Energy with an access easement across city property at Latham Park, in exchange for a drainage easement. The easement requested by Duke Energy will provide them with access for a utility installation project adjacent to an existing tower. The drainage easement provided to the City is advantageous for further development and construction on site at the park.  Duke Energy would also like to convey a portion of their property to the City currently impacted by the Latham Park greenway, as a fee simple transaction.  City Council approval is requested for the easements and acceptance of property conveyance.

 

BACKGROUND:

Latham Park is located at 601 Open West Wendover Avenue and runs linear along North Buffalo Creek from Hill Street to North Elm Street. The Hill street side of Latham Park will be home to the new skate park development adjacent to the Latham Park Greenway. Duke Energy is seeking to install a Verizon Wireless static utility installation adjacent to an existing tower and the greenway. In order to facilitate the process of approval for both projects, the City and Duke Energy have collaborated to provide each other with access easements at the site.    The proposed access easement from the City to Duke Energy is approximately 2,653SF. The proposed drainage easement from Duke Energy to the City is approximately 1,511SF. During the surveying of Latham Park property, it was discovered that the greenway also impacts Duke Energy’s property. As result, Duke Energy would like to convey approximately 2,407 SF of its property to the City through a fee simple transaction

 

The subject property to be conveyed is located at 800 Hill Street, parcel #0001892.  This property is owned by Duke Energy.  The subject property to be granted is located at 901 Wharton Street, parcel #0001891.  This property is owned by the City of Greensboro.

 

Both properties are zoned Residential, R-5.  The area to be conveyed by Duke Energy to the City of Greensboro for the Latham Park Greenway is 2,407 Sq. Ft. (.060 acres).  Duke Energy will also be granting a Permanent Drainage Easement to the City of Greensboro of 1,511 Sq. Ft. (.035 acres).  The City of Greensboro is granting a Permanent Access Easement of 2,653 Sq. Ft. (.061 acres).

 

BUDGET IMPACT:

There will be no budget impact. The subject areas will be dedicated and conveyed without compensation. 

 

RECOMMENDATION / ACTION REQUESTED:

The Property Management Section of the Engineering & Inspections Department recommends the approval of this conveyance and acquisition.
