PURPOSE:
To authorize Capital Facilities Foundation (UNCG non-profit) to install fiber optic infrastructure in the City’s rights-of-way for this particular installation and future installations.
BACKGROUND:
The Greensboro City Council is enabled to allow encroachments in City rights-of-way provided such encroachments will neither cause a public nuisance nor unreasonably interfere with the use of the streets and sidewalks by the public. Capital Facilities Foundation desires to install 220’ fiber optic along the right-of-way along Silver Ave. Capital Facilities Foundation Incorporated has agreed to enter into a Global Encroachment Agreement with the City which, among other things, will indemnify the City from any claim or damages that may occur due to the installation of the fiber optic infrastructure. This Global Encroachment will allow City staff to review, approve, and permit future sites.

RECOMMENDATION / ACTION REQUESTED:
It is recommended that City Council approve the Resolution authorizing a Global Encroachment Agreement between the City of Greensboro and Capital Facilities Foundation Incorporated to install fiber optic infrastructure.
