PURPOSE:
The Police Department requests approval to enter into a sole source contract with Bode Cellmark Forensics, Inc. for DNA analysis and testing for criminal investigative follow-up and evidentiary purposes. The Police Department wishes to contract for one year ($50,000), with two optional one-year extensions. City Council approval is required to sole source a purchase under State Public Contracting Statute GS 143-129 (e)(6) which allows exceptions to the letting of public contracts for the purchase of apparatus, supplies, materials or equipment when standardization or compatibility is the overriding consideration.
BACKGROUND:
In this particular case, sole source is recommended as Bode Cellmark Forensics, Inc. is the only non-governmental DNA lab from which the NC State Crime Lab will accept developed DNA profiles for subsequent comparison examinations and associated CODIS entry. As a result, Bode Cellmark Forensics, Inc. is the sole provider of the service requested. The Police Department has contracted with Bode Cellmark Forensics, Inc. since 2016 for such services and have been satisfied with the company’s performance.
BUDGET IMPACT:
Funds are budgeted in the Police Forensics Division account 101-3533-01.
RECOMMENDATION / ACTION REQUESTED:
The Police Department requests that City Council approve the sole source contract with Bode Cellmark Forensics, Inc. to perform DNA analysis.
