PURPOSE:
To approve the annual renewal of enterprise software in perpetuity provided that sufficient appropriations are approved by City Council in succeeding fiscal years.
BACKGROUND:
The purchase of enterprise software and enterprise software subscriptions require annual renewals to ensure that the software is up to date and that the end user has access to the software. Under a perpetual license, an annual software maintenance agreement is required to ensure that the end user continues to receive software upgrades and necessary security patches. Under a subscription license, an annual renewal is required for the life of the subscription service and covers the cost of software upgrades, security patches and general support. Annual software renewals for enterprise software is required for continued use of the software. Therefore we consider City Council’s initial approval of the software to implicitly approve all necessary future maintenance agreements and renewals.

RECOMMENDATION / ACTION REQUESTED:
That once City Council has approved the initial purchase and installation enterprise software, the City Manager is authorized to enter into annual subscription and software maintenance renewals in perpetuity provided that sufficient appropriations are approved by City Council in succeeding fiscal years.
