PURPOSE:
City Council approval is requested for a change order to Contract 2009-004A for the W. Market Street and Guilford College Road Intersection Improvements Project. This change order for $130,456.00 is to provide additional railway construction services that were not included in the original contract.
BACKGROUND:
This project includes federal funding and is subject to the U.S. Department of Transportation Disadvantaged Business Enterprise (DBE) program. The M/WBE Program Plan expressly states, "...the following categories of contracts shall be excluded from the scope and application of this Program Plan: (a) Contracts that are subject to the U.S. Department of Transportation Disadvantaged Business Enterprise Program and Airport Concessions Disadvantaged Business Enterprise Program as set forth in 49 CFR Parts 23 and 26 or any successor regulations or legislation."
This projects also includes railway construction work within the existing Norfolk Southern Railway right of way. Any work associated with the railway within the railroad right of way is exclusively controlled by Norfolk Southern and they have exclusive control over who performs their contract work.
This change order is necessary to widen the existing railway vehicle crossing on Guilford College Road to accommodate the roadway widening. This change order will update the railway construction pricing that was included in the original contract as ...
