PURPOSE:
City Council approval is requested for a change order to Contract 2014-053 (EB-5518) for the Latham Park Greenway Improvements Project. This change order for $76,152.20 is to account for additional work required to complete this project.

BACKGROUND:
Contract 2014-053 (EB-5518) in the amount of $473,774.00 was issued to Atlantic Contracting Company, Inc. on May 6, 2020, for the construction of the Latham Park Greenway Improvements Project. During construction, additional work needed within the railroad right of way was discovered that resulted in additional construction costs. Additional costs were also incurred due to the addition of sidewalk and curb ramps needed for ADA compliance that were not part of the original contract.

This project includes Federal funding and is subject to the U.S. Department of Transportation Disadvantaged Business Enterprise (DBE) program. The M/WBE Program Plan expressly states, "...the following categories of contracts shall be excluded from the scope and application of this Program Plan: (a) Contracts that are subject to the U.S. Department of Transportation Disadvantaged Business Enterprise Program and Airport Concessions Disadvantaged Business Enterprise Program as set forth in 49 CFR Parts 23 and 26 or any successor regulations or legislation."

The DBE goal for this project is 2.0%. Atlantic Contracting Company, Inc. is a DBE firm and will achieve a DBE commitment of 2.1% with its own workforce.
