PURPOSE:
City Council is requested to delegate authority to the Greensboro Minimum Housing Standards Commission to file petitions in the Guilford County Superior Court in compliance with North Carolina General Statutes Section 160D-1130 - Vacant Building Receivership (formerly codified at Section 160A-439.1).

BACKGROUND:
In accordance with recently adopted state legislation amending North Carolina General Statutes Section 160D-1130 regarding vacant property receivership, the governing body of a municipality or its delegated commission may petition the superior court for the appointment of a receiver to rehabilitate, demolish or sell a vacant building, structure or dwelling as a resolution for specified non-compliance.

The City's Minimum Housing Standards Commission is the body which hears both residential and non-residential cases and requires compliance with Orders to Repair or Demolish. The receivership process as outlined in state law is a method to achieve compliance with the Commission's Orders. The City's Code Compliance Division drafted a pilot plan to test the process.

The Commission plans to utilize the services of the City Attorney or employ independent attorneys or law firms to file such petitions, as selected by the City Attorney.
