PURPOSE:

City Council approval is requested for a Utility Reimbursement Agreement for U-2581BA with the North Carolina Department of Transportation (NCDOT) to support the construction of water and sewer line relocations and utility betterments to be installed with NCDOT Project U-2581BA.  City Council approval of the agreement in the amount of $1,246,707.00 is requested.

 

BACKGROUND:

The North Carolina Department of Transportation (NCDOT) is prepared and adopted plans to make highway improvements under Project U-2581BA in Guilford County. The project will include widening US 70 from Mount Hope Church Rd to Birch Creek Rd.  The transportation improvements are in direct support to economic development in the area.  City Council approval of a Utility Agreement is requested to support construction activities related to maintaining a reliable and consistent water service for our current and potential customers in the area. The NCDOT U-2581BA contract was awarded for $11,125,538.10.   NCDOT is responsible for the widening improvements, intersection improvements and utility construction relocations located within existing permanent utility easements, while the City is responsible for the utility construction relocations and betterments of the water and sewer infrastructure located within the public right of way and represents 11.2% of the overall funding of the project. The NC Department of Transportation (State) is financing 88.8% of the funds for the project.   The project includes the construction of sections of 8-inch gravity sewer and 12-inch water main, 8-inch sewer force main relocations, and 8-inch and 16-inch water main relocations.

 

This project is subject to the State MBE/WBE Program which establishes appropriate goals for participation of minority and women owned businesses.  Like the City of Greensboro’s MWBE Program, the State program requires the selected vendor to make good faith efforts to meet the goals, either meeting the established goals or demonstrating that adequate good faith efforts were made to meet them.  This is a component of a narrowly tailored program that the courts have supported for use by any governmental agency operating a race or gender conscious MWBE program.  The MBE/WBE goals for this project are MBE 5% and WBE 5%.  The participation achieved was MBE 7.02% and WBE 3.02%.

 

BUDGET IMPACT:

Funds are budgeted in the following Water Resources Capital Improvements Fund accounts in the amount of $1,246,707.00.  A budget adjustment is needed to use these accounts.

RECOMMENDATION / ACTION REQUESTED:

The Water Resources Department recommends that City Council adopt a resolution authorizing the execution of the Utility Agreement between the North Carolina Department of Transportation and the City of Greensboro for the estimated cost of $1,246,707.00, and the associated budget adjustments.
