PURPOSE:

Leoterra New Garden, LLC has requested the release of an easement located on 5598 and 5594 Garden Village Way. This resolution will authorize the release of the easement requested by the land owner.

 

BACKGROUND:

The 20-foot Storm Easement was established in Plat Book 149 on Page 69. Only the portion located from a point 20 feet west of the property line along Garden Village Way westward and northward can be released.

 

Due to development of the site the easement are no longer needed.

 

Planning staff has received confirmation that all utilities have approved or had no objection to the release of this easement.

 

BUDGET IMPACT:

This item will have no impact of the budget.

 

RECOMMENDATION / ACTION REQUESTED:

Accordingly, it is recommended that on May 19, 2020, the City Council adopt a resolution releasing the above-mentioned easement.
