PURPOSE:

Authorize the City Manager to add the sum of $500,000 in new non-taxpayer funded Sponsorship Revenues to any of the professional service contracts to design the Steven B. Tanger Performing Arts Center (“STPAC”) referenced in Council Resolutions 0209-13 and 0348-17 and any of the purchasing contracts for the Theatrical Specialty Equipment (“TSE”) referenced in Council Resolution 92-17.

 

BACKGROUND:

Pursuant to the Memorandum of Understanding between the City and the Community Foundation of Greater Greensboro (“CFGG”), the City contracted with fifteen different design professionals (i.e. architects, engineers, and consultants) to design the STPAC.  Each design professional and their general responsibility were as follows:

The original not to exceed amounts of each of these individual contracts are listed in Attachment A to this Agenda Item. The total not to exceed amount for all 15 contracts was $5 million.  The City and CFGG obtained 15.1% M/WBE participation in these Professional Service design contracts.  Local M/WBE firms included in the design of the STPAC were John Davenport Engineering, Inc., Palma Engineers, PLLC, Landscape Design Collaborative, and One Design Center, Incorporated.  The design of the STPAC was originally expected to take approximately one year.  City Council’s December 19, 2017 Resolution,  0348-17, increased the “not to exceed amount” of these 15 contracts by an additional $820,619.88 to pay for the changes to the Scope of Services and related fees amongst these design professionals over the course of three (3) years after the execution of their initial contracts.

 

Through the generosity of several well-known local Corporations and longtime Greensboro families, the Coliseum has raised an additional $2,725,000 in new non-taxpayer Sponsorship Revenue Funding for the STPAC.  The bid specifications for the STPAC included additional City requested alternate scopes of work (“Add-Alternates”) that could be added to the STPAC project if additional funding ever became available.  As part of its bid, Barnhill Contracting Company, and the other bidders, included prices for these Add-Alternates in its bid price.  Since the City did not accept these Add-Alternates at the time of the December 19, 2017 Council Resolution approving Barnhill Contracting Company’s contract, these costs were not included in the original contract price of $57,900,000. 

 

These additional non-taxpayer Sponsorship Revenues will be used to offset various increased design costs required by the Owner’s Add-Alternates costs incurred or pending including:

 

1)                     Completion of Third Floor Pre-Function Space

2)                     Elm St. Patio Water Fountains;

3)                     Elm St. Green Wall;

4)                     Landscape Irrigation Cistern;

5)                     Brenner Place Vestibule Entrance;

6)                     Southeast Monumental Signs/Planter seat wall;

7)                     East/West Façade Limestone Additions;

8)                     East Walkway Canopy;

9)                     North Stage Wall Exterior Lighting;

10)                     Parking Entrance Gates; and

11)                     Chamber Building Administrative Offices/Prep Kitchen/Inventory Storage renovations

 

Additionally, since the original April 25, 2017 Council Resolution approving the purchase of the Specialty Theatrical Equipment for the STPAC, the start of construction has been significantly delayed, because the City broke the STPAC project into two phases to save money, and the City experienced historical 100-year rain levels during 2019.  As a result, the costs to install this equipment have increased, and since these funds will also allow the City to incorporate several Add-Alternates, changes in the design for some of this equipment will also be necessary. 

 

City staff is asking the City Council to authorize the City Manager to use $500,000 of these additional new non-taxpayer funded Sponsorship Revenues to pay for the expanded Architectural and Engineering Design Scope of Services and the additional costs to purchase and install the Theatrical Specialty Equipment. 

 

BUDGET IMPACT:

No general fund expense or revenue accounts will be impacted.  The Performing Arts Center Fund budget will be increased by $500,000 of these new non-taxpayer funded Sponsorship Revenues to fund the design of the STPAC and the purchase and installation of the Theatrical Specialty Equipment.

Pass a Resolution authorizing the City Manager to add $500,000 in new non-taxpayer funded Sponsorship Revenues to any of the professional service contracts to design the Steven B. Tanger Performing Arts Center referenced in Council Resolutions 209-13 and 348-17 and to any of the purchasing contracts for the Theatrical Specialty Equipment referenced in Council Resolution 92-17.
