PURPOSE:

City Council is being requested to enter into an inter-local agreement for involuntary commitment and transportation. The agreement is between Guilford County, the City of Greensboro, the City of High Point and the Town of Gibsonville.  The agreement memorializes the duties and responsibilities of each jurisdiction in relation to the involuntary commitment process.

 

BACKGROUND:

Pursuant to NC General Statute 122C-251, the law enforcement agencies in Guilford County have entered into an agreement for transportation of respondents in involuntary commitment proceedings. The statute was amended and effective October 1, 2019 and the process needed to be formalized.

 

N. C. Gen. Stat. 122C-251(g) was amended in 2019 and requires the governing body of a city or county to adopt a plan known as an “involuntary commitment transportation agreement” or “transportation agreement” for the custody and transportation of respondents in involuntary commitment proceedings.  Pursuant to the provisions contained in this statute, officers and attorneys with Greensboro Police Department, High Point Police Department, Guilford County Sheriff’s Office and Gibsonville Police Department, met and agreed on a county wide “Agreement for Involuntary Commitment Transportation.  The Agreement has been approved by all the three Chiefs and the Sheriff.  The Resolution seeks the adoption of this Agreement by City Council.  Prior to the enactment of statute requiring a formal agreement, the agencies had an informal understanding among the departments.

 

BUDGET IMPACT: There is no budget impact.

 

RECOMMENDATION / ACTION REQUESTED:

The police department requests this resolution be adopted.
