PURPOSE:
City Council is requested to approve the execution of a contract Change Order Request (COR) to DH Griffin Construction Company on the Steven Tanger Performing Arts Center (STPAC) Phase 1 “site work” project. The project was approved by City Council at the April 25, 2017 City Council meeting. When installing the water and sewer piping, DHG encountered unforeseeable obstacles that had to be removed and the good soil had to be trucked in. These items included a section of an old city cobblestone street, old mechanical pipelines/pipe tunnel, and an old 20,000-gallon #2 fuel oil tank, filled with a third (1/3) of odd fuel oil. In addition, this COR also includes the parking lot site lighting conduit. A change order is required to fund the extra cost for these unforeseeable conditions that are over and above the construction contingency. The DH Griffin’s STPAC “Phase 1 “contract would need to be increased in the amount of $385,268.
BACKGROUND:
At the April 25, 2017 City Council Meeting, the City Council approved staff to enter into a Construction contract for “Phase 1” not to exceed $2,501,729.15. On June 20, 2017, DH Griffin submitted the lowest Responsible/Responsive bid in the amount of $1,220,750. In addition, DH Griffin made a good faith effort to meet or exceed the M/WBE goals on this project while using the same M/WBE sub-contractor as part of this change order. The MWBE percentages were “50% WBE, 2% MBE”. As a result, a contract was issued to DH Griffin on July 6, 2017.
BUDGET IMPACT:
The change order in the amount of $385,268 will be funded within the Performing Arts Center capital project budget from account no. 527-7501-01.6011. A budget adjustment is necessary to use this account.
RECOMMENDATION / ACTION REQUESTED:
The Coliseum Complex staff request that City Council approve this contract change order request with DH Griffin in the amount of $385,268.
