PURPOSE:

City Council is being requested to amend section 18-24 of Chapter 18 of the Greensboro Code of Ordinances with respect to Offenses and Miscellaneous Provisions to add twelve athletic fields and facilities, and remove two facilities no longer operated by the City of Greensboro. 

 

BACKGROUND:

Per North Carolina General Statute Section 14-415.23 Statewide uniformity, a unit of local government may adopt an ordinance to permit the posting of a prohibition against carrying a concealed handgun, in accordance with G.S. 14-415.11. The City of Greensboro exercises this right and has signage posted at recreation fields and facilities prohibiting the carry of concealed handguns during organized athletic events for which a person or organization scheduled the athletic field for use with the Parks and Recreation Department. The term “during” is construed to mean the period of time in which such athletic field is used for the organized athletic event and a one-hour period before and after the athletic event.  

 

The Parks and Recreation Department Athletics Section is in the process of updating its Athletic Field Rules signage in an effort to maintain consistency in signage at the various locations, replace signage that is out of date, and create signage that promotes a safe and fun environment for participants, spectators, and users of our athletic fields and facilities.

 

Per General Statute, to enforce the ordinance, signage must be posted stating concealed carry is prohibited. However to post signage, the city ordinance must list the athletic field or facility in which signage is being posted. The current ordinance is missing the following athletic fields and facilities; Ballfield at Allen Middle School, Ballfields at Glenwood Center Park, Tennis Courts at Lake Daniel Park, Ballfield at Lewis Center Park, Ballfield at Old Peck Park, Pickleball Courts at Smith Senior Center park, Ballfield at Warnersville Center Park, Sprayground at Keeley Park, Interactive Fountain at LeBauer Park, Page High School Tennis Courts, Tennis Courts at Latham Tennis Center, and Tennis Courts at Spencer Love Tennis Center. The current ordinance also includes the Golf Course at Bur-Mil and Aquatic Facility at Bur-Mil, which are no longer owned and operated by the City of Greensboro, meaning both can be removed from the ordinance.

 

This amendment request and information was presented to the Greensboro Parks and Recreation Commission on Wednesday, September 12 and passed unanimously to proceed to Greensboro City Council for approval to amend Section 18-24 of the Greensboro code of Ordinances.

RECOMMENDATION / ACTION REQUESTED:

It is recommended that City Council approve an ordinance amending Section 18-24 of Chapter 18 of the Greensboro Code of Ordinances with respect to Offenses and Miscellaneous Provisions to add the following facilities to the ordinance; Ballfield at Allen Middle School, Ballfields at Glenwood Center Park, Tennis Courts at Lake Daniel Park, Ballfield at Lewis Center Park, Ballfield at Old Peck Park, Pickleball Courts at Smith Senior Center park, Ballfield at Warnersville Center Park, Sprayground at Keeley Park, Interactive Fountain at LeBauer Park, Page High School Tennis Courts, Tennis Courts at Latham Tennis Center, and Tennis Courts at Spencer Love Tennis Center, and remove the Golf Course at Bur-Mil and Aquatic Facility at Bur-Mil from the ordinance.
