PURPOSE:

To delegate signature authority for Stormwater Operation and Maintenance Agreements to the City Manager’s Office.

 

BACKGROUND:

Pursuant to DEQ regulations, developers who construct stormwater control devices are required to enter into binding Stormwater Operation and Maintenance Agreements with the City of Greensboro.  These Agreements must be filed with the Guilford County Register of Deeds.  It is unusual that O&M Agreements must be filed with the Register of Deeds, and typically the Mayor signs documents that are filed with Register of Deeds.  For these agreements, it would be more efficient and timely for the City Manager’s office to have signature authority and to delegate this signature authority to the appropriate Department Director/Assistant Directors.  These Agreements must be filed with Guilford County upon final plat approval, and developers who are seeking final approvals for their projects would welcome this streamlined approach.

It is recommended that City Council delegate signature authority for Stormwater Operation and Maintenance Agreements to the City Manager’s office.
