PURPOSE:

City Council approval is requested to convey an easement to KB NC Holdings, LLC for a building encroachment on City property used for Gillespie Golf Course.

 

BACKGROUND:

KB NC Holdings, LLC, the owner of Parcel #0056515, also known as 501 Patton Avenue, discovered that its building encroaches upon City property known as 312 East Florida Street.  The owner is requesting that the City grant an easement so that the building may remain in its present location.  The owner has offered to indemnify the City and provide payment of $500 as consideration for the easement.

 

In accordance with City Charter §4.128(b), the Parks and Recreation Department has determined that the building encroachment does not interfere with the operation of Gillespie Golf Course and that there is no governmental or other public purpose which would be in conflict with the proposed easement or the use of the easement. 

 

BUDGET IMPACT:

No budget impact is expected with the conveyance of easement.

 

RECOMMENDATION / ACTION REQUESTED:

The Parks and Recreation Department recommends that City Council approve the easement for a building encroachment of approximately 8.72 square feet and authorize the Mayor and City Clerk to execute the appropriate deed of easement.
