PURPOSE:
A resolution needs to be approved in order to add additional Federal and State funds to cover costs associated with Battleground-Benjamin-Cone Intersection Improvements Project U-5306A and extend the completion date.

BACKGROUND:
The Battleground-Benjamin-Cone Intersection Improvements project (U-5306A) consists of adding additional left and right turn lanes, median islands to control access on Battleground Avenue, traffic signal modifications, the construction of sidewalks, and removing free-flow right right-turns to improve pedestrian and vehicular safety. Project construction is well underway with completion expected in 2018.

NCDOT agreed to fund the project after the MPO submitted it for consideration under NCDOT's Prioritization 1.0 project selection process in 2010. NCDOT made an 80% federal and a 20% state funding commitment to the project. Per NCDOT policy, the Department agrees to reimburse the City for 100% of eligible project costs.

The U-5306A municipal agreement was executed in 2011. The funding level in that agreement was based on preliminary cost estimates. The City recently requested and NCDOT agreed to provide additional funding for this project to cover eligible expenses based on actual contract costs. The enclosed supplemental agreement adds this funding and extends the project completion date until December 31, 2018.

Under the terms of the executed municipal agreement, the City must adhere to all NCDOT requirements including the DBE program and commitments.
