PURPOSE:
An ordinance needs to be approved to appropriate additional Federal funds associated with the amended municipal agreement with NCDOT for the Lovett Street Sidewalk Project (EB-5712).

BACKGROUND:
Project EB-5712 will construct sidewalks on both sides of Lovett Street from Freeman Mill Road to Florida Street to improve pedestrian safety, accessibility, mobility, including for students to and from Peck Elementary School. NCDOT agreed to reimburse the City for construction costs after the Metropolitan Planning Organization (MPO) submitted the project for consideration under the Prioritization 3.0 process. The City Council approved execution of the funding agreement on March 15, 2016. The Department has agreed to increase its funding participation at this time based on awarded contract and NCDOT oversight costs.

The original agreement provided for a reimbursement of 100% of construction costs up to $369,903 in Federal Safe Routes to School funds. However, the combined costs for the construction and inspections contracts and NCDOT administration fees are $558,960. NCDOT has agreed to cover 80% of the additional costs ($151,246) using Federal Transportation Alternatives Program funds.

On July 18, 2017, City Council approved the construction contract and adjusted the budget to use bond funds to cover the difference between the contract amount and the amount in the municipal agreement. This agreement will reduce the overall amount of local bond funds required for this project.
