PURPOSE:

To give the first approval of the franchise agreement between the City of Greensboro and MCNC, A Non-Profit Corporation.

 

BACKGROUND:

North Carolina General Statute §160A-76 requires that all franchise grants, renewals, extensions, or amendments be made by ordinance and also requires that all such ordinances be passed at two regular meetings of the City Council.

 

The City of Greensboro and MCNC, A Non-Profit Corporation have entered into a franchise agreement which will receive its first approval by ordinance at the August15th, 2017 City Council meeting.  This is the first of two regular meetings of the City Council at which the franchise agreement may be approved.

 

The franchise agreement begins on September 5th, 2017 for a term of ten (10) years with an option for MCNC, A Non-Profit Corporation to renew for an additional five (5) year period by notifying the City in writing. This franchise will allow MCNC, A Non-Profit Corporation to insert fiber optic into City right of way in order to serve the Greensboro Public Library at 219 N. Church Street, Guilford County Schools at 712 Eugene Street, and Triad Math and Science Academy at 700 Creek Ridge Road. Each have been reviewed internally by City departments.

 

BUDGET IMPACT:

This private installation has no impact upon the City budget. All MCNC infrastructure is the responsibility of MCNC.

 

RECOMMENDATION / ACTION REQUESTED:

It is recommended that City Council give the first approval of the franchise agreement between MCNC, A Non-Profit Corporation and the City of Greensboro.
