PURPOSE:
To amend provisions of the City Code to expand the criminal background check requirements for solicitors and street performers to cover sexual offenses as offenses which would require denial of a business permit.

BACKGROUND:
Section 13-202 of the City Code of Ordinances requires solicitors to obtain a business permit prior to selling door to door at private residences. Prior to issuing the permit, the Greensboro Police Department conducts a criminal background check to determine whether the applicant has previously violated the Licenses, Taxation, Business Permits and Miscellaneous Business Regulations Chapter or has been convicted of misdemeanor or felony assault, communication a threat, or illegal use of weapons. If the applicant has been convicted of certain offenses in the last five years, then the permit will be denied. The proposed amendment will add sexual offenses and abuse involving a minor to the list of crimes which result in denial of the permit if convicted of one or more offenses in the past 10 years.

Section 13-203 of the City Code of Ordinances requires street performers to obtain a business permit prior to performing on public property. Prior to issuing the permit, the Greensboro Police Department conducts a criminal background check to determine whether the applicant has been convicted of offenses involving an assault, communicating a threat, illegal use of a weapon, or other act of violence or attempted violence.
