PURPOSE:
To grant an encroachment agreement in City right-of-way for the fiber optic cabling for communication needs of Crown GHO, LLC. When public or private entities request to use City right-of-way, it is required that they secure approval by City Council.
BACKGROUND:
City officials approached Crown GHO, LLC when the Engineering & Inspections Department discovered a fiber optic cable during a sidewalk project on W. Wendover Avenue. This fiber optic route was found in State right-of-way and needed to be rerouted due to the sidewalk project. Crown GHO, LLC fiber optic cable was also indentified in City right-of-way as seen on Exhibit A and is required to become compliant with regulations regarding occupation of City right-of-way.
The City and Crown GHO, LLC have agreed to enter into an encroachment agreement for use of City right-of-way per Greensboro Code of Ordinances, Telecommunications 28.1. This encroachment will not cause a public nuisance or unreasonably interfere with the use of streets and sidewalks by the public.
This encroachment has been reviewed and approved by Engineering & Inspections, Transportation, Water Resources, and Legal.
BUDGET IMPACT:
The City will receive an annual fee of $.30 per linear foot from Crown GHO, LLC for fiber optic occupation in City rights-of-way. The annual fee of $71.10 for 237 linear feet of fiber optic cabling and will be deposited into account number 101-6010-01.7803.
