PURPOSE:

The purpose of the text amendment is to amend Sections 30-4-5.8 and 30-15-16 of the Land Development Ordinance to remove Protest Petitions. The City Council is required to hold a public hearing on this amendment before considering its approval.

 

BACKGROUND:

The Land Development Ordinance currently includes provisions for the submission of Protest Petitions related to rezoning requests.

 

Protest Petitions are a formal petition filed in opposition to a rezoning that triggers a requirement for a supermajority affirmative vote of City Council to approve the amendment.

 

Section 160A-385 of the North Carolina General Statues allows municipalities to include provisions for Protest Petitions in their Zoning Regulations. The mechanics for Protest Petitions in the City of Greensboro are specified in Section 30-4-5.8 of the Land Development Ordinance.

 

The North Carolina General Statues have been amended and the ability to incorporate Protest Petitions in the rezoning process has been removed, effective August 1, 2015.

 

This amendment would remove Protest Petitions from the Land Development Ordinance

 

BUDGET IMPACT: There will be no impact on the current or future budgets.

 

RECOMMENDATION / ACTION REQUESTED:

The Planning Board recommended this amendment at its August meeting on a vote of 6-0. Staff recommends that City Council receive citizen comments and consider adoption of the proposed text amendment.
