PURPOSE:
To request the second of two required approvals of the franchise agreement between the City of Greensboro and Fiber Technologies Networks, LLC. The first approval by City Council occurred on August 3rd, 2015, and this ordinance received nine affirmative votes.
BACKGROUND:
Second Reading: This ordinance received nine affirmative votes for its first approval at the August 3, 2015 meeting of Council.
North Carolina General Statute ?160A-76 requires that all franchise grants, renewals, extensions, or amendments be made by ordinance and also requires that all such ordinances be passed at two regular meetings of the City Council.
The City of Greensboro and Fiber Technologies Networks, LLC have agreed to enter into a franchise agreement per Greensboro Code of Ordinances Chapter 28.1 Telecommunications. This will allow Fiber Technologies Networks, LLC to place small cell deployment in City right of way including fiber optic and poles used for cellular communication. This is the second regular meeting of the City Council at which the franchise agreement may be approved by ordinance.
This franchise agreement begins August 18, 2015 for a term of ten (10) years with an option for Fiber Technologies Networks, LLC to renew for an additional five (5) year period by notifying the City in writing.
BUDGET IMPACT:
The City will receive an annual franchise fee of $0.30 per linear foot of Fiber Technologies Networks, LLC fiber optic installations in the City's rights-of-way. The annual franchise fee is $19,166.40 for 63,888 linear feet of...
