PURPOSE:
Council approval is requested for a contract change order on Contract 2010-113 (C-5555A) with Atlantic Contracting Company, Inc., for General Sidewalk Improvements in the amount of $94,452.00. The cost of the change order is for expenses that will be reimbursed at 80% by the North Carolina Department of Transportation.

BACKGROUND:
The contract work entails installing approximately 2.4 miles of concrete sidewalks; along with driveways, retaining walls, ADA compliant concrete curb cuts, and safety rails. Funding is provided from the federal Congestion Mitigation and Air Quality (CMAQ) program with 80% reimbursement of the contract costs. Atlantic Contracting Company was awarded the contract by Council on December 2, 2014, in the amount of $853,757.50. The contractor used DBE participation of 9.4%, exceeding the goal of 9% set by NCDOT, and they must meet the goal on the entire contract, including all change orders. Five sidewalk projects make up the contract, one of which is along W. Wendover Avenue from Edwardia to Oak Branch. Along with the sidewalks, some curb-and-gutter and pavement patching is required to install curb ramps for ADA compliance.

Due to an extended negotiation period for easements at the U. S. Postal Service property at the bulk mail center on Wendover Avenue, a gap was left in the Wendover section of the sidewalks. Those negotiations have been successfully completed and the easements purchased, so adding this work back into the Wendover sidewalk is the basis for a change order.
