PURPOSE:
To grant an encroachment agreement in the City's right-of-way for the installation of two awnings at Freeman's Grub and Pub located at 1820 Spring Garden Street.
 
BACKGROUND:
Joshua Kirkman and Jessica Dewey, owners of J&J Spring Garden LLC, operate Freeman's Pub and Grub.  They are in the process of adding awnings to their property at 1820 Spring Garden Street, Greensboro, NC 27403.  Plans have been submitted to the City regarding the installation of four (4) awnings to be added to the exterior of the building.  
 
Two of the awnings will reside above exterior doors along S. Chapman Street and will encroach upon the City's right-of-way.
 
Greensboro City Charter 4.128 (c) allows City Council to grant an encroachment beyond the existing building line for erecting a structure over the right-of-way if the encroachment will not cause a public nuisance or unreasonably interfere with the use of streets and sidewalks by the public.
 
Because the two awnings will be located above the doorways, they will not cause a public nuisance and they will not unreasonably interfere with the use of streets or sidewalks by the public.
 
BUDGET IMPACT:
There will be no budget impact.
 
RECOMMENDATION / ACTION REQUESTED:
Engineering & Inspections recommends that City Council grant an encroachment agreement for the installation of two awnings in City right of way at 1820 Spring Garden Street.
