PURPOSE:
AECOM Technical Services of North Carolina, Inc. (AECOM) has requested to use City right-of-way to check for contamination, investigate any related subsurface or surface conditions and take necessary response actions related to Burnett's Cleaners and Laundry located at 1932 East Market Street. When public or private entities request to use the City's right-of-way, it is required that they secure approval by City Council.

BACKGROUND:
AECOM works as a contractor for the North Carolina Department of Environment and Natural Resources (Division of Waste Management). AECOM will initially be taking soil, water, and air samples within the platted right-of-way of Rankin Street to ensure the dry cleaners' compliance with regard to the North Carolina Dry Cleaning Solvent Cleanup Act program. It is the intent to determine the extent of contamination to the south of Burnett's Cleaners and Laundry. There are past installations of wells pertaining to Burnett's Cleaners and Laundry by a prior contractor, ATC Associates, Inc. which was approved by City Council for a Global Encroachment Agreement on June 5th 2007.

Under this temporary global encroachment agreement AECOM may take other actions related to the investigation of surface and surface conditions by constructing temporary and permanent monitoring wells. Each future location will be approved by appropriate City departments.

This encroachment has been reviewed and approved by Engineering & Inspections, Transportation, Water Resources, and Legal.
