PURPOSE:
American Express Travel Related Services Company, Inc. (Amex) has requested to terminate their encroachment agreement to use City right-of-way at 7701 Airport Center Drive. When public or private entities request to terminate their use of the City's right-of-way, it is required that they secure approval by City Council.
 
BACKGROUND:
On April 20, 1999 City Council approved the Amex encroachment beneath 7701 Airport Center Drive to provide connectivity between existing buildings on each side of Airport Center Drive. A partial termination of this encroachment was approved by City Council on September 16, 2008, leaving sixty (60) linear feet of fiber optic lines for continued use. Amex has removed the remaining fiber optic connection, sealed the conduit and is requesting to have the agreement fully terminated.
 
This encroachment termination has been reviewed and approved by Engineering & Inspections, GDOT, and Legal.
 
BUDGET IMPACT:
Any expenses related to the maintenance and repair related to the unused remaining conduit are the responsibility of Amex. This agreement termination will reduce the FY2016 revenue budget for General Fund by $105.00.
 
RECOMMENDATION / ACTION REQUESTED:
Engineering & Inspections recommends the approval of the termination of this encroachment.
