PURPOSE:
City Council approval is requested to convey a utility easement to Duke Energy in order for them to install a new electrical power service at the Chamber of Commerce Building on City property adjacent to the new Stephen Tanger Performing Arts Center.

BACKGROUND:
The Chamber of Commerce building on North Elm Street is located on a property purchased for the Stephen Tanger Performing Arts Center. The Chamber building needs a new electrical service installed for the facility which also requires relocation of the transformer. Duke Energy requires an easement to move the existing transformer and install a new underground line on the site

Since the easement is an encumbrance on City property, City Council approval is required for the transaction.

BUDGET IMPACT:
No funds are required, and there is no budget impact.

RECOMMENDATION / ACTION REQUESTED:
The Engineering & Inspections Department recommends that City council approve the conveyance of the utility easement to Duke Energy Corporation so they can install and maintain electrical service to the Chamber of Commerce Building.
