PURPOSE:
The City Council is requested to set a public hearing date of April 21, 2015 for amendments to Sections 30-3-7.4, Powers and Duties, 30-3-7.5, Required Vote for Approval and 30-4-26.5, Sign Permits; and to amend Section 30-8-13 (if not repealed by Council action on April 7) of the Land Development Ordinance (LDO). This change is requested to replace references to privilege licenses and add clarifying language regarding the Board of Adjustment. At the April 21, 2015 hearing City Council will consider and take action on this request.
BACKGROUND:
Section 30-4-4.6, Waiver of Procedure, grants City Council the ability to hear an ordinance text amendment directly, bypassing Planning Board review and recommendation. These proposed amendments replace the term "privilege license" with the term "business permit" to reflect City changes resulting from the repeal of the privilege license tax by the State of North Carolina (effective June 30, 2015). The amendments will also clarify the role of the Board of Adjustment in hearing appeals from other portions of the City Code and confirming how persons voting on variances are to be counted for determining whether or not a request can be approved.

This item will have no budget impact.
