PURPOSE:
Michael Baker Engineering, Inc. is required to provide additional engineering inspection services for the federally funded Wendover Avenue Sidewalk, EL5101DD, project. City Council approval of a contract extension to the professional services contract with Michael Baker Engineering in the amount of $71,616.72 is requested.
 
BACKGROUND:
This construction project consists of constructing approximately 4.75 miles of sidewalk along E. Wendover Avenue within the City of Greensboro. The limits of the project are US -29 and Penry Road, which is a long project for the City. Construction began February 10, 2014, with anticipated completion by October 28, 2014. The construction contract was awarded to Little Mountain Builders of Catawba County, Inc. (located in Maiden, NC) with a bid of $1,057,824.73.  
 
On December 2, 2013, the City Manager approved award of a design contract to Michael Baker Engineering, Inc., for $217,511.30 for the construction engineering inspection of the work. That contract is 80% reimbursable under the federal grant. Michael Baker Engineering is an engineering design firm with a branch office in Greensboro. A contract extension is required to add the cost of extended inspection times resulting from contractor delays and additional driveway work. The new total contract amount will be $289,128.02. Council approval is required for an extension.
 
Construction Engineer Inspections (CEI) is frequently used on federally funded projects to comply with grant guidelines enforced by the NCDOT. Funding for the CEI services is included in the municipal agreements that provide reimbursement for construction expenses. The cost of the CEI services is very difficult to forecast, because the cost is very dependent on the performance of the general contract as well as any change in the scope of the project. As with all federally funded projects, there is no budget contingency to cover unanticipated costs.
 
This contract has a provision for charging the general contractor for liquidated damages that result from the contractor's delays in completing the contract on time. When the final determination on the number of days that the contractor is late, liquidated damages will be assessed at $500 per day. The number of days assessed will require an agreement between the contractor, NCDOT, the Federal Highway Administration, and the City.
 
BUDGET IMPACT:
This engineering inspection contract extension in the amount of $71,616.72 is funded in account: 401-4538-01.6015 and activity A09158.
 
RECOMMENDATION / ACTION REQUESTED:
The Engineering & Inspections Department recommends approval of the contract extension for the Wendover Avenue Sidewalk EL5101DD Contract 2008-054A in the amount of $71,616.72.
