PURPOSE:  
The City Manager is required to inform City Council of any North Carolina Department of Labor, Occupational Safety and Health Division (OSHA) citations that the City receives.
 
BACKGROUND:  
On January 15, 2015, the City received a citation and notification of penalty from the North Carolina Department of Labor, Occupational Safety and Health Division (OSHA) regarding the presence of asbestos at the War Memorial Auditorium (WMA) (see attached).  The citation carried a proposed penalty of $3,250 and was issued to the City for not having appropriate signage and boundaries separating the contaminated area from the rest of the workplace. On January 22, 2015, the City had an informal conference with OSHA to further discuss the penalty and executed a settlement agreement to reduce the penalty to $2,100.  
 
As an update, the asbestos contamination in the WMA has been cleaned up and the full abatement process will be completed this week. Once complete, we will begin the re-bid process for the demolition of WMA and anticipate that work to be complete early spring. In addition, we are also continuing our review of this item and will address any areas of concern that we (or others identify) to ensure we do not have a similar situation occur in the future.  
 
BUDGET IMPACT:  
The city is responsible to pay the $2,100 fine.
