PURPOSE:
Authorize the execution of a Municipal Agreement with the North Carolina Department of Transportation (NCDOT) for design, right-of-way and construction funding for B-5553 Ballinger Road Bridge Project and approve the associated budget ordinance.

BACKGROUND:
On August 27, 2014 the Transportation Advisory Committee amended the Metropolitan Transportation Improvement Program to include B-5553 Ballinger Road Bridge Replacement Project over a tributary to Horse Pen Creek with right-of-way funding in 2016 and construction funding in 2017. This bridge replacement project (just east of the recently reconstructed bridge on Ballinger Road over Horse Pen Creek) is needed to replace a structurally deficient bridge over a tributary to Horse Pen Creek. Back in early 2014 the MPO had submitted a project request to NCDOT for evaluation under the Prioritization 3.0 project selection process. NCDOT recently selected the project for funding under the federal Surface Transportation Program (STP) -Off System Bridge Program due to the bridge's very low structural sufficiency rating relative to other bridge replacement needs in the state.

The attached Municipal Agreement with the North Carolina Department of Transportation (NCDOT) establishes funding responsibilities, billing procedures, and the terms to which the City must adhere in completing the work. Right-of-way and construction costs will be reimbursed on an up to 80% basis, not to exceed $752,000 in STP-Off System Bridge funds from NCDOT.
