PURPOSE:
The proposed amendment will change the avenue of citizen appeals taken from the decision of a City official concerning motor vehicle towing orders issued under Chapter 17 of the Code of Ordinances.  Currently, appeals of such decisions require a quasi-judicial hearing before a Code Enforcement Officer.  The proposed amendment will send the appeal to the Board of Adjustment, which is a specialized City board that routinely processes quasi-judicial appeals.  
 
BACKGROUND:  
The Office of the City Attorney has reviewed current towing procedure and determined this amendment is advisable to ensure the due process rights of citizens are protected.
 
BUDGET IMPACT:      None
 
RECOMMENDATION / ACTION REQUESTED:
Staff requests that City Council approve the amended ordinance section as proposed.
