PURPOSE:
The bids for Contract 2013-079 (Mitchell Sediment Basin Building Structural Improvements/Mitchell Filter Plant HVAC Improvements) have been received. In order for the work to proceed on this contract, City Council approval is requested for award of the contract to Wharton-Smith, Inc. in the amount of $2,462,000.00.

BACKGROUND:
This work consists of all labor, equipment, and incidentals required for structural, HVAC, process chemical feed systems, piping, and demolition improvements at the Mitchell Water Treatment Plant. The proposed date for start of construction is October 20, 2014. The proposed date of completion is July 17, 2015.

The bids were opened on July 24, 2014 and the apparent lowest, responsible bidder is Wharton-Smith, Inc. (Lake Monroe, Florida) with a bid of $2,462,000.00.

The M/WBE utilization goal MBE 10% and WBE 12%. Upon completion of a Good Faith investigation and review by the M/WBE Office a determination was made that the company met the WEB goal and demonstrated adequate Good Faith Efforts to try to meet the MBE goal. The actual MBE goal commitment was decreased from 10.6% to 0% because of the proposed MBE firm (CITI located in Mecklenburg County) did not meet the Significant Business Presence requirement in the M/WBE Program Plan. The final contract commitment is MBE 6.5% and WBE 16.0%.
