PURPOSE:
Establish authority for the Historic Preservation Commission to conduct public hearings related to the award of contracts with Municipal Service District funds.
BACKGROUND:
In 1989, Municipal Service Districts were established in the College Hill and Aycock Historic Districts under NCGS 160A-536 for the purpose of providing improvements above and beyond what the City typically provides in order to preserve and enhance the character of these historic districts. In 2015, the North Carolina Legislature Amended the State Statute related to the award of contracts in Municipal Service Districts. In order to comply with the new statutory provisions, a public hearing is required prior to City Council awarding any contract utilizing Municipal Service District funds.
The Historic Preservation Commission meets on a monthly basis, and regularly conducts public hearings. The Commission is made up of uniquely qualified representatives from the Historic Districts and the preservation community.

RECOMMENDATION / ACTION REQUESTED:
Staff recommends the designation of the Historic Preservation Commission as the venue for Public Hearings related to the award of contracts in the Municipal Service District.
