PURPOSE:
The Property Management section of the Engineering & Inspection Department is in the process of selling a non-buildable parcel to the adjoining owner as part of the Battleground/ Cone/ Benjamin Roadway Project #P04554. There is no municipal need or use for the property. The sale is part of a condemnation settlement. City Council approval is requested to proceed with the sale of this property to the adjoining owner.
BACKGROUND:
Property Management made an offer to the owners at 2614 & 2618 Battleground Avenue to purchase a substantial amount of land off of the front of their property for Right-of-Way needed for this project. The owners of this property are Buskers LTD, LLC and Permus, LLC.
The City owns a narrow strip of land next to the property that is remnant land from the widening of Cone Boulevard. The land has been used for parking by the adjacent Buskers/Permus property since the widening. This property is needed by the property owners to offset the loss of parking caused by the intersection improvement on Battleground Avenue scheduled for October 2014.
Using a recommendation and an independent appraisal by D. Lynn Cable (MAI), Property Management offered the remnant land to Buskers/Permus with a value of $26,000. The owners had an appraisal done by McNairy & Associates with a value of $11,200. In a mediated settlement agreement through Superior Court, it was agreed that the City will sell the land for $15,000, and the buyers will pay their attorney fees and resurface the parking lot with new striping. The mediated agreement includes the provision to present a request for approval of the sale to City Council on August 4, 2014.
