PURPOSE:

To grant an encroachment agreement in City right-of-way for fiber optic cabling for communication needs of Union Square Campus, Inc. When public or private entities request to use City right-of-way, it is required that they secure approval by City Council.

 

BACKGROUND:

Union Square Campus, Inc officials approached the Engineering & Inspections Department to install a fiber optic route for communication needs. This will service future development within the Union Square Campus project area. The route will begin at the Union Square Campus in the 500 block of Arlington Street and terminate at an existing communication manhole located in the northwest corner of the intersection of Gorrell Street and Bennett Street. This fiber optic route in City right-of-way is seen on Exhibit A.

 

The City and Union Square Campus, Inc. have agreed to enter into an encroachment agreement for use of City right-of-way per Greensboro Code of Ordinances, Chapter 28.1 Telecommunications. This encroachment will not cause a public nuisance or unreasonably interfere with the use of streets and sidewalks by the public.

 

This encroachment has been reviewed and approved by Engineering & Inspections, Transportation, Water Resources, and Legal.

 

BUDGET IMPACT:

The City will receive an annual fee of $.30 per linear foot from Union Square Campus, Inc for fiber optic occupation in City rights-of-way. The annual fee of $1,488.60 for 4,962 linear feet of fiber optic cabling and will be deposited into account number 101-6010-01.7803.

 

RECOMMENDATION / ACTION REQUESTED:

Engineering & Inspections recommends that City Council grant an encroachment for the use of fiber optic cabling in City right-of-way for Union Square Campus, Inc.
