PURPOSE:
The North Carolina Railroad Company (Company) has submitted the attached Non-Standard License Agreement (Agreement) to formalize the City’s occupation and use of the Company’s right-of-way and the right-of-way of the Norfolk Southern Railroad Company by the City’s J. Douglas Galyon Depot. Since the Company is owned by the State of North Carolina, this Agreement is an intergovernmental agreement that requires City Council approval.
BACKGROUND:
This agreement is necessary because the City of Greensboro’s J. Douglas Galyon Depot and its operations encroach on the right-of-way of the North Carolina Railroad Company, who leases its property to the Norfolk Southern Railway Company. The attached agreement provided by the Company has an initial $200 administrative and handling fee and an annual licensing fee of $6,200. The annual licensing fee will increase3% every year that the Agreement is in existence and the Agreement will remain in effect in perpetuity until the agreement is amended or terminated by either party.
BUDGET IMPACT:
Funding is approved through the current annual budget. Future funding allocations are subject to City Council approval.
RECOMMENDATION / ACTION REQUESTED:
City Council approval of a resolution authorizing the City Manager to execute a Non-Standard License Agreement with the North Carolina Railroad Company and the Norfolk Southern Railway Company to allow for the continued operation of the City of Greensboro’s J. Douglas Galyon Depot.
