PURPOSE:
The property owner has requested the closing of several “old” portions of Bryan Boulevard, North Regional Road and Caindale Drive. Staff requests that City Council hold a public hearing to receive public comment and to consider adoption of the street closing resolution.
BACKGROUND:
This request involves three portions of right-of-way:
1. PL(P) 19-25: The “old” portion of Bryan Boulevard from a point approximately 116 feet east of the centerline of North Regional Road eastward a distance of approximately 550 feet to the current City of Greensboro corporate limit line. With the previous relocation of Bryan Boulevard and the completion of the construction of I-73, the North Carolina Department of Transportation withdrew the southern half of street from the state system on February 5, 2004, and withdrew the northern half from the state system on August 2, 2018. Guilford County closed the portion to the east (in the County’s jurisdiction) by resolution in May of 2004 and is currently processing the street closing request for the portion to the north (in the County’s jurisdiction). The petition has been signed by the owners having frontage along 1,425 feet (100%) of the 1,425 feet of frontage along the portion of street to be closed.
2. PL(P) 19-26: The “old” Portion of North Regional Road along the frontage of 520 North Regional Road. With the previous relocation of Bryan Boulevard and North Regional Road, Guilford County closed the portion to the south (in the County’s jurisdiction) by resolution in April of 2003. The petition has been signed by the owners having frontage along 290 feet (100%) of the 290 feet of frontage along the portion of street to be closed.
3. PL(P) 19-27: The “old” portion of Bryan Boulevard / Caindale Drive from the southern right-of-way line of I-73 southward a distance of approximately 365 feet to the current City of Greensboro corporate limit line. With the completion of the construction of I-73, the North Carolina Department of Transportation withdrew this portion of street from the state system on August 2, 2018. Guilford County is currently processing the street closing request for the portion to the east and south (in the County’s jurisdiction). The petition has been signed by the owners having frontage along 1,325 feet (100%) of the 1,325 feet of frontage along the portion of street to be closed.
The closings are being requested so that the land can be added to the abutting property to aid future development.
BUDGET IMPACT:
There will be no impact on the current or future budgets.
RECOMMENDATION / ACTION REQUESTED: The Technical Review Committee (TRC) feels circumstances here allow the City to make the two required determinations for a street closing: (1) that closing the street to vehicular traffic is not contrary to the public interest, and (2) that no property owner in the vicinity is deprived of reasonable means of ingress and egress.
Therefore, the Technical Review Committee (TRC) recommended the closing with the condition that the City shall retain 20-foot utility easements over existing utility lines until such time as the lines are no longer needed for public us.
The Planning Board recommended this closings, with the stated conditions, at its September meeting on a vote of 7-0.
Accordingly, it is recommended that on October 15, 2019, the City Council hold a public hearing to receive public comment and to consider adoption of the resolution closing the “old” Portions of Bryan Boulevard, North Regional Road and Caindale Drive.
