PURPOSE:
The bids have been received for North Buffalo Creek Water Reclamation Facility Modifications (NB-WRF) and for TZ Osborne Construction Package 1 (TZO-WRF), Contract 2011-038. In order for the work to proceed on this contract, City Council approval is requested for award of the contract to Garney Construction Co., Inc. in the amount of $7,530,000.00.
BACKGROUND:
This work, the first part of the Water Reclamation Facilities 56 MGD (million-gallons/day) Upgrade project, is being issued as Package 1. It consists of demolition and new construction at the North Buffalo Creek Water Reclamation Facility (NB-WRF), and new construction at the T. Z. Osborne Water Reclamation Facility (TZO-WRF). The North Buffalo project includes demolition of all major process facilities except for the admin/laboratory buildings, the transfer pumping station, and one aeration basin. Conversion of the one aeration basin will provide 2 MG (million-gallons) of holding capacity for the plant. The T. Z. Osborne project includes the installation of a new equalization tank for 4.5 MG of additional holding capacity.
The bids were opened on July 10, 2014 and the apparent lowest, responsible bidder is Garney Construction Company, Inc. (Kansas City, MO) with a bid of $7,530,000.00. The contractor's commitment is MBE 14.2% and WBE 0.92%. The M/WBE utilization goals were MBE 10% and WBE 5%.
A good faith investigation and review were made, and it was determined that the contractor did make a good faith effort to comply with the MWBE policy.

The proposed date for start of construction is October 6, 2014. The proposed date of completion is April 5, 2016.
BUDGET IMPACT:
Funds for this construction contract are budgeted in Water Resources Capital Improvements Fund account 515-7056-02.6019 A14106. A budget adjustment is needed to use this account.
RECOMMENDATION / ACTION REQUESTED:
It is recommended by the Departments of Engineering & Inspections and Water Resources that City Council approve the bid and award Contract 2011-038 (North Buffalo Creek WRF Modifications and TZ Osborne Construction Package 1) to Garney Construction Co., Inc. for the bid amount of $7,530,000, and the associated budget adjustment.
