PURPOSE:
The Property Management Section of the Engineering & Inspections Department is in the process of selling vacant surplus property located at 2113 Tuscaloosa Street (parcel #0013863). City Council approval is requested to proceed with the sale of this property to the highest bidder.
BACKGROUND:
Property Management first advertised this property with a vacant house for sale on December 17, 2013. Property Management has accepted the highest bid from TCC Holdings, LLC in accordance with Section 4:122 of the City Code of Ordinances, "Sale of Real Property by Advertisement for Bid".
The property, including both the land and the house, was appraised by Lynn R. Ritchy, an independent appraiser, on December 3, 2013 with a value of $10,000. After showing this property to numerous investors and buyers, the dwelling was determined to be uninhabitable due to extremely poor conditions, and it was determined that the structure would be demolished by the City if not sold. In August of 2014 it was decided that in order to sell the property prior to demolition, the $8,000 appraised value of the land alone would be used as the list price. The highest and final bid of $7,200 was accepted. This accepted bid was advertised in the News & Record with a 10 day upset period which has expired with no further bids.
The house is under an Order to Alter, Repair or Remove as of April 24, 2014. The buyer has received and acknowledged the order. The Neighborhood Development Department will give the new owner thirty days after the property transfer to commence the work to comply with the order.
The property was acquired by a Commissioner's Deed through the foreclosure process on November 13, 2013. It has been determined that there is no municipal need for the property. The property lot size is 7,405 Sq. Ft., (.17 acre). The house is approximately 768 SF. The property zoning is R-5, Residential.
The accepted sales price complies with the Department's policy requiring sales prices to be at least 90% of the appraised value of properties.
BUDGET IMPACT:
The proceeds from the sale of this property will be credited against foreclosure accounts receivable (101-0000-00.0400). Once all costs related to advertising and property transfer are paid, any net remaining balance will be recorded as revenue or loss on the sale of foreclosed property.
RECOMMENDATION / ACTION REQUESTED:
The Property Management Section of the Engineering & Inspections Department recommends that City Council approve and authorize this sale of surplus property at 2113 Tuscaloosa Street at the highest bid of $7,200.
