PURPOSE:
City Council approval is requested to approve a reimbursement agreement between SHVF Olympic, LLC “Self Help Venture Funds” and the City of Greensboro for the design and construction of Phase 1 of the proposed North Buffalo Creek Greenway.
BACKGROUND:
SHVF Olympic, LLC owns property located at the 1601 Yanceyville Street, which is being developed at the former Olympic Mill (Revolution Mill) site. The City and SHVF Olympic, LLC have agreed on a reimbursement agreement for the design and construction of Phase 1 of the proposed North Buffalo Creek Greenway in an amount not to exceed $500,000.
Construction of Phase 1 initiates the development of four-phases of the North Buffalo Creek Greenway. Upon completion, the North Buffalo Creek Greenway will tie into the existing Latham Park and Lake Daniel Greenways, and will improve walking and bicycling conditions, as well as, increase pedestrian connectivity to and from the Revolution Mills development. The reimbursement agreement creates a public-private partnership between the City and SHVF Olympic, LLC that will allow SHVF Olympic, LLC to complete design and construction of Phase 1 of the Greenway simultaneously with work already being completed on the site.
The terms and conditions of the agreement related to the construction include installation of a pedestrian bridge, permission from Norfolk Southern for construction of Phase 2, appropriate signage, and potential future collaboration for the construction of Phase 2 and design of Phase 3 and Phase 4 of the Greenway. The City will also hold Self Help Ventures Funds to general City contracting authorizations and delegations. At its January 11, 2017 meeting, the Parks and Recreation Commission unanimously approved a recommendation to City Council for the submission of the reimbursement agreement between Self Help Ventures Funds and the City of Greensboro for consideration.
Pursuant to Section 2-91 of the City’s Code of Ordinances, the City may approve reimbursement agreements with private developers and property owners for the design and construction of municipal infrastructure, including greenways upon certain conditions. First, City staff concludes that the coordination of a separately constructed greenway with the associated development of the Revolution Mill site would be impracticable. Second, SHVF Olympic, LLC has agreed to comply with the requirements of G.S. 143-129 and G.S. 143-128(f) relating to public advertising and bid opening requirements if City would be bound by these statutes in awarding this construction contract. Third, SHVF Olympic, LLC has agreed to comply with the City's Minority/Women's Business Enterprise Program with respect to the design and construction of the Phase 1 of the Greenway.
The M/WBE Office reviewed the documentation submitted by SHVF Olympic, LLC. (Self Help Venture Funds) to determine compliance with the City of Greensboro M/WBE Program Plan. The M/WBE Goal Setting Committee established contract specific goals of MBE 6% and WBE 7%. SHVF Olympic, LLC. (Self Help Venture Funds) has exceeded both goals by proposing to commit to MBE (12.1%) and WBE (7.9%) goals with certified firms. (See attached).BUDGET IMPACT:
The total project cost is not to exceed $500,000. The funding has been identified in account number 453-5006-01 (2006 Bond Fund - Trail System Expansion).
RECOMMENDATION / ACTION REQUESTED:
It is recommended by the Parks and Recreation Commission that City Council approve the reimbursement agreement between SHVF Olympic, LLC “Self Help Venture Funds” and the City of Greensboro for the construction of Phase 1 of the proposed North Buffalo Creek Greenway, in an amount not to exceed $500,000.
