PURPOSE:
Waheed A. Tijani is requesting rezoning from O (Office) zoning district to CD-C-L (Conditional District- Commercial-Low) for property located at 1304 Woodside Drive, generally described as the northeast intersection of Summit Avenue and Woodside Drive and north of Mayfair Avenue.
 
As the Zoning Commission decision for this case was appealed, the City Council will conduct a public hearing to consider and take action on this request at its June 17, 2014 meeting.
 
BACKGROUND:
Following a public hearing on May 12, 2014, the Zoning Commission voted 5-3 to deny this request.  One person spoke in favor of the request and 4 in opposition. (See attachment B: Minutes of the May 12, 2014 Zoning Commission meeting). Because the Zoning Commission's decision to deny the request was subsequently appealed, this appeal will be heard by City Council.
 
The proposed rezoning request to CD-C-L (Conditional District- Commercial-Low) includes the following conditions:
 
1.      Uses shall be limited to all uses permitted in the C-L district except any use with a drive through facility.
2.      The total building area shall not exceed 3,600 square feet.
The current Office (O) zoning for this property primarily allows various office and personal and professional service uses.  If approved, the requested Conditional District Commercial-Low (CD-C-L) zoning will also allow smaller scale retail, restaurant and convenience uses (without drive throughs) in addition to the currently allowed uses.
 
This request addresses the following MAP Goals:
 
MAP Goal 1 - Create an environment that promotes economic development opportunities and job creation
MAP Goal 2 - Maintain infrastructure and provide sustainable growth opportunities
 
 
BUDGET IMPACT:
 
This item will have no budget impact.
 
RECOMMENDATION / ACTION REQUESTED:
 
The Zoning Commission voted 5-3 to deny this request.
 
Planning recommends approval of the request based on:
 
-      Request is consistent with the Reinvestment/Infill goal to promote sound investment in Greensboro's urban areas.
-      Request is consistent with the Economic Development goal to promote a healthy, diversified economy.
-      Request implements measures to protect neighborhoods from negative impacts of development.
