PURPOSE:
The property management section of the Engineering & Inspection Department is in the process of selling a portion of excess City right-of-way that adjoins 400 W. Whittington St., parcel #0003413. City Council approval is requested to proceed with the sale of this property to the adjoining owner.
 
BACKGROUND:
Property Management was contacted by The Salvation Army to purchase a portion of excess right-of-way along Freeman Mill Road that adjoins their property. As part of their development plan the area will allow them to shift their proposed building towards Freeman Mill Road. This sale is in accordance with City ordinance section 4.124, (Sale or Exchange of Excess Property). There are no other adjoining owners. The property, which is currently right-of-way only, was appraised by Tonya Brady, an independent appraiser, with a value of $15,000. The Salvation Army agreed to pay the appraised value.
 
The right-of-way for this portion of Freeman Mill Road was originally acquired by the NCDOT for the construction of the Freeman Mill Road bridges over Spring Garden Street, the railroad and Lee Street in the late 1960's. That right-of-way was subsequently transferred to the City along with the maintenance costs of the street.
 
The size of the portion of land is approximately 24,393 square feet, (0.56 acre). It is not currently zoned because it is right-of-way but the adjoining property is zoned PI, Public and Institutional.
 
BUDGET IMPACT:
The proceeds of this sale will be deposited in the General Fund Sale of Real Estate Account #101-0000-00.8616.  
 
 
RECOMMENDATION / ACTION REQUESTED:
The Property Management Section of the Engineering & Inspections Department recommends that City Council approve the appraisal and authorize the sale of this portion of right-of-way for $15,000.
